Purpose & Values

1.Village web site (www.createvillage.net) has been established in line with the vision and objectives of Neighbourhood that Works (NTW) (www.ntw.110mb.com) as an information source and a non hierarchical organizing tool for grass roots communities and individuals.

Ownership

NTW is a not for profit coalition of volunteers who, being agreed on the values and principles outlined on the NTW home page, have worked together to developed Village. Village web site (www.createvillage.net) is the property of the NTW developers who hold the benefit of all disclaimers and limitations of liability in these terms and conditions of use.

Usage Agreement
2. The content, functionality and all other elements of www.createvillage.net are offered to each user only on these terms and conditions and any other specific terms and conditions that apply to any particular part of this website. Use of this website on each separate occasion constitutes acceptance by that user of this offer.

3. Each agreement that is formed by each user on acceptance of this offer is governed exclusively by the laws of New South Wales, Australia.

Copyright
4. All material on this website is protected by Australian and international copyright and other intellectual property laws. Users may not do anything which interferes with or breaches those laws or the intellectual property rights in the material. You are welcome to reproduce for personal, in-house or non-commercial use any material displayed at the website as long as you clearly state the source of your information. In the event that you wish to reproduce, alter, store or transmit this material for a purpose other than personal, in-house or non-commercial use, you may apply to the developers of Village at neighbourhoodthatworks@gmail.com The developers of Village cannot and do not grant you any permission or authority in respect of the copyright in the material which is posted to our site by others (including material provided by way of online discussion forums), or which is displayed by us but authored by someone else (eg articles, conference papers, guides and other resources) or which appears at third-party Internet sites linked to our site (we strongly recommend that you refer to the copyright statements at those sites before making use of the material). Although we make this Web site freely accessible, we do not give up our rights, or anyone else's rights, to the materials appearing on the site. We do not claim ownership of individual postings, comments, text, photos, videos or other content or materials posted by members, but all other materials available through this Web site are the property of the developers of Village, and are protected by copyright, trademark and other intellectual property laws. In addition, content displayed on or through our site, whether posted by members or provided by the developers of Village, may be owned both by the person who created or licensed that content and by us as part of a collective work and/or compilation under Australian and international copyright laws and treaties. Village does not claim ownership of content that you create and submit or make available on the service. However, if you post text or comments on Village, you grant Village a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, publicly perform, distribute, display, and create derivative works based on such content throughout the world in any media, and to incorporate such content into other works in any format or medium now known or later developed, for any purpose. If you post photos, graphics, audio or video on Village, you grant Village the license to use, adapt, publicly perform and publicly display such content on Village By posting content to Village, you represent and agree that
(i) You are the owner of the content, or otherwise have the right to post such content to this site.
(ii) The content is accurate.
(iii) The content will not violate the rights of or cause injury to any person or entity.
(iv) You will indemnify Village for any claims resulting from content that you submit to the site.

Registration rules
5. To post information or comments on the Village Web site, or to obtain access to certain Village services, you must become a registered user of the site. In the registration process, you will be required to provide your name, e-mail address, post code, suburb. You also will be asked to select a member name and a password. Rules for Discussion Forum Users: You agree that the information you supply during the Village registration process, and maintain after registration, will be accurate and complete and that you will not supply the e-mail address of, register under the name of, or attempt to access the site under the name of, another person. By participating in the discussion forum, you consent to disclosure to the public of your email address. If you provide information about another person, you are responsible for ensuring that you have the permission of that person to provide the information. Postings must be directly relevant to the vision and objectives of the site. No defamatory comments or inciting of violence/intolerance of any community group No abuse, insults or personal attacks No foul language No inappropriate or illegal material, including breaching of copyright ?No "For Sale", "Wanted to Buy" or "Position Vacant" postings? Responsibilities
6. We assume no responsibility or liability for the deletion, corruption, or loss of any content submitted by a Village member, or for failure to receive or store submitted content for any reason, including, without limitation, malfunctioning of any network, hardware or software. You will be solely responsible for any and all content of whatever nature that you post on, transmit via or link to from the Village site.

7. Due to the desire to promote a free exchange of opinion and information, the developers do not necessarily endorse or support the views, opinions, standards or information which appears at this site or any linked sites. The developers do not review content submitted by Village members before it appears on Village (although they reserve the right to remove, modify, edit, move all content). Village members are urged to post only accurate information, but there is no guarantee that postings are accurate, impartial or objective, and there is no assurance or representation as to the veracity of members or the quality of the information posted to the site. The material which appears at the site or any linked sites is not warranted as complete, current, reliable and/or free from error. You are urged to use common sense and good judgment in deciding whether to rely on the information contained on the site. You understand that you must personally evaluate, and that you bear all risks associated with the use of, any content you find, including any reliance on the accuracy, completeness or usefulness of that content. The developers of Village cannot accept any responsibility or liability for any loss, damage, cost or expense you might incur as a result of the use of or reliance upon the materials which appear at this or any linked sites, whether or not caused by their negligence. Also, some material which appears at the site and any linked sites may possibly cause offence or upset to some people. The developers regret this, but cannot take responsibility for, any such offence or upset caused. If you see something on the site that you believe is inaccurate, or about which you hold a different opinion, feel free to post a comment. If you see something on the site that you believe violates the terms of use, interferes with the ability of others to enjoy the site, or is otherwise objectionable, you may email neighbourhoodthatworks@gmail.com. In the event that you are offended by the material which appears at an Internet website, you are also entitled to lodge a complaint with the Australian Broadcasting and Media Authority (ACMA), who will then investigate the complaint and take such action as it thinks fit. 8. The developers have the right (but not the obligation), in our sole discretion, to screen content submitted by our members and to edit, move, delete, and/or refuse to accept any content that in our judgment violates the terms of use or is otherwise unacceptable or inappropriate, whether for legal or other reasons.

9. One registration per person is allowed for each region of Village and will be validated on unique email address.

10. All functionality on the Village website is subject to change and the developers are not liable for any loss of content experienced through this action.

11. Subject to any other specific restrictions or conditions that apply to any particular content on this website, each user may only download, view, listen, watch, copy and/or print a copy of material on the following conditions: ONLY FOR personal and non-commercial use; NOT FOR any use that is defamatory, unlawful or in breach of any third party's rights (including, without limitation, rights of privacy and intellectual property rights); NOT to establish, maintain or provide, or assist in establishing, maintaining or providing a separate publication, website or other means of distribution; and WITHOUT modification (including of any copyright notice). All rights that are not expressly granted are reserved.

12. This website may include third party content and hyperlinks and pointers to websites operated by third parties. The developers are not responsible in any way for third party content, whether it is included in this website or in any third party website which is sourced using any hyperlink or pointer contained on this website. The developers do not endorse, recommend or otherwise make any representation or statement in relation to any third party content on this website.

13. In its use of the website, a user must not:

  • defame, abuse, harass, stalk, threaten or otherwise offend others;
  • publish or disseminate any material which is unlawful, obscene or defamatory;
  • use any automated scripting tools or software;
  • engage in or promote any surveys, contests, pyramid schemes, chain letters, unsolicited e-mailing or spamming;
  • impersonate any person or entity;
  • upload, post, e-mail, transmit or otherwise make available any material in breach of any other person's rights (including intellectual property rights) or which contains viruses, or other computer codes, files or programs designed to interrupt, limit or destroy the functionality of other computer software or hardware;or
  • breach any applicable laws or regulations.

14. The developers have no responsibility or liability in relation to any loss or damage incurred by a user, including damage to your software or, arising from your use of or access to this website. NTW does not make, and excludes, any warranty, representation or other statement as to the accuracy, currency, timeliness or completeness of any material contained on the website. The developers do not exclude any rights and remedies available to a user under the Trade Practices Act or any similar state or territory legislation that cannot be excluded, restricted or modified. Otherwise, the developers exclude all conditions and warranties that may be implied by law.

15. The developers may terminate access to the website at any time without notice and for any period. The developers disclaimers and limitations of liability, and the restrictions imposed on the user, continue survive both the developers termination of access, and any termination of the agreement between Village and each user. The developers may terminate access and delete all content attributed to the site by said user, to the website if it is suspected that a user is using false or fraudulent information. The developers reserve the right to reject or terminate the use of any member name that they deem offensive or inappropriate. The user is responsible for maintaining the confidentiality of your Village password and account, and you are responsible for all activities that occur under your password and account.

16. If you see something on the site that you believe is inaccurate, or about which you hold a different opinion, feel free to post a comment. If you see something on the site that you believe violates the terms of use, interferes with the ability of others to enjoy the site, or is otherwise objectionable, email neighbourhoodthatworks@gmail.com

Please remember that any information submitted to the site for publishing becomes accessible to everyone using the site. You should exercise caution when deciding to disclose your personal information or other peoples' personal information.
